USCIS received approximately 172,500 petitions subject to the annual H1B cap during the FY2015 filing period, which began April 1, 2014, including petitions filed under the advanced degree H1B cap exemption. This means that nearly 85,000 H1B candidates will not receive an H1B for the coming fiscal year beginning October 1, 2014 (FY2015). It also means that if Congress does not act, H1B candidates who did not receive an H1B number for the coming fiscal year must wait until the beginning of the following fiscal year (FY2016, which begins October 1, 2015) to try once again for an H1B. more »

red lights with arrows 96913798USCIS announced today (April 7, 2014) that they have received a sufficient number of H-1B petitions to reach the statutory H-1B cap for fiscal year 2015 (FY2015). USCIS has also received more than the limit of 20,000 H-1B petitions filed under the US advanced degree H-1B exemption. Unless Congress acts, no new cap-subject H-1B numbers will be available until October 1, 2015 (the first filing date for an October 1, 2015, employment start date is April 1, 2015). more »

The Service anticipates that it may receive more petitions than the H-1B cap allows between April 1, 2013 and April 5, 2013. In that case, USCIS will hold a lottery to determine which cap-subject FY2014 H-1B petitions they accept for consideration. Note that those who do not file a cap-subject FY2014 H-1B petition before the annual quota is exhausted may be locked out of the H-1B program until the start of the following fiscal year (FY2015), which begins October 1, 2014. more »

H-1B Cap: Too Few H-1Bs Issued Last 5 Years

Pile of documents 100923010A recent Freedom of Information Act (FOIA) request by attorney David Rudman of Chicago shows that USCIS has been seriously underutilizing annual H-1B numbers by about 15%–that is, USCIS has not been issuing enough H-1B numbers to meet the annual H-1B quota over the last 5 years. During this time, USCIS appears to have issued 45,000 fewer H-1B visas than it should have. It is likely that it has done the same this year as well. more »

East Village Skyline NYC 147055098As of June 1, 2012, USCIS had received 55,600 cap-subject FY2013 H-1B petitions subject to the regular 65,000 cap (for beneficiaries without a US advanced degree), and 18,700 FY2013 H-1B petitions subject to the 20,000 cap exemption for individuals with US advanced degrees. The FY2013 H-1B cap will likely be filled within the next week.  more »
